D3G working on BABA compliance by taking a look at architectural drawings for affordable housing.

The Build America, Buy America Act (BABA) is a federal domestic-content requirement now affecting most affordable housing developments that receive Federal Financial Assistance (FFA). For project teams already managing a capital stack, a construction schedule, and a closing date, it raises real questions.

D3G’s BABA Compliance Consulting turns those open questions into a clear, five-step practical plan, so compliance becomes one less thing standing between you and your closing date.

YOUR PATH TO COMPLIANCE

Our BABA Compliance Consulting Process

D3G built a five-stage framework so our clients always know where they stand and what happens next.

1. Review the Funding Sources

We identify every source of Federal Financial Assistance to determine which scopes and line items must meet BABA’s domestic-content requirements, before specs are finalized.

2. Determine What's In Play

We assess cost exposure, schedule risk, and waiver eligibility against your specific project. Scoped to your unique  systems, timeline, and funding source.

3. Product & Public Interest Waivers

We identify which building materials and components may qualify for a waiver and review the cost and availability of alternatives.

4. Waiver Preparation & Submission

We organize the documentation, due-diligence record, and project-impact narrative into the required format, and assist through submission and approval.

5. Construction Administration & Close-out
We can provide ongoing construction administration support to help maintain BABA compliance throughout the construction process. The result is a comprehensive, organized, and audit-ready BABA compliance file documenting the project’s compliance from procurement through completion.

Wherever You Sit on the Project, BABA Probably Affects You

BABA compliance rarely sits with just one role, it touches funding, design, procurement, and construction all at once, and no single team member owns the full picture.

D3G integrates directly into your existing project team to bring a consistent, coordinated compliance framework across every stage, so BABA is managed as one clear process rather than something each stakeholder handles on their own.

D3G works directly with:

  • Affordable housing developers: know your BABA exposure before it affects closing, draws, or placed-in-service dates.
  • General contractors: turn BABA into a controlled procurement process instead of a documentation scramble.
  • Architects & design professionals: build BABA-compliant specification language and submittal requirements into the drawings from the start.
  • Affordable housing attorneys & LIHTC consultants: once the legal applicability determination is made, D3G handles the technical due diligence, product review, and documentation that follows.
  • PHAs, MTW agencies, and housing finance agencies: standardize BABA compliance procedures, waiver processes, and draw controls across your entire pipeline.
  • Lenders, syndicators, and investors: use BABA due diligence as a transaction risk-management tool before financing milestones are at risk.

Frequently Asked Questions

BABA stands for the Build America, Buy America Act, enacted as part of the Infrastructure Investment and Jobs Act (IIJA). It establishes a domestic-content procurement preference for infrastructure projects receiving Federal Financial Assistance.

It depends on whether the project receives Federal Financial Assistance covered by BABA, which can include HOME Investment Partnership Funds, CDBG, NHTF, GRRP, CNI, MTW, Section 202 forward commitments and many other “soft” federal sources. Applicability is driven by the funding source and award terms, not the project type alone, which is why a funding review is always the first step.

No, this isn’t treated as proof of BABA compliance. The record needs to be built from correspondence, quotations, data sheets, country-of-origin declarations, and technical evaluations that can withstand agency or audit review.

BABA assigns covered products to one of three categories: iron or steel products, manufactured products, and construction materials. Each category has its own domestic-content test. D3G’s product characterization step assigns the correct category before any sourcing decision is made.

There are three general waiver types: non-availability, unreasonable cost, and public interest, plus a de minimis general waiver that can cover smaller noncompliant line items without a project-specific waiver request. D3G evaluates which pathway fits and helps prepare the documentation.

As early as possible, ideally before bidding and before procurement begins. BABA compliance is strongest when it’s designed into specifications and bid documents up front, rather than addressed after a product has already been ordered or installed.

Approved products can change through substitutions, change orders, supplier shifts, or value engineering, and each of those can affect BABA compliance. D3G’s process re-checks classification and sourcing whenever the approved scope changes, and ties everything back into an audit-ready closeout package.
