BABA stands for the Build America, Buy America Act, enacted as part of the Infrastructure Investment and Jobs Act (IIJA). It establishes a domestic-content procurement preference for infrastructure projects receiving Federal Financial Assistance.
It depends on whether the project receives Federal Financial Assistance covered by BABA, which can include HOME Investment Partnership Funds, CDBG, NHTF, GRRP, CNI, MTW, Section 202 forward commitments and many other “soft” federal sources. Applicability is driven by the funding source and award terms, not the project type alone, which is why a funding review is always the first step.
No, this isn’t treated as proof of BABA compliance. The record needs to be built from correspondence, quotations, data sheets, country-of-origin declarations, and technical evaluations that can withstand agency or audit review.
BABA assigns covered products to one of three categories: iron or steel products, manufactured products, and construction materials. Each category has its own domestic-content test. D3G’s product characterization step assigns the correct category before any sourcing decision is made.
There are three general waiver types: non-availability, unreasonable cost, and public interest, plus a de minimis general waiver that can cover smaller noncompliant line items without a project-specific waiver request. D3G evaluates which pathway fits and helps prepare the documentation.
As early as possible, ideally before bidding and before procurement begins. BABA compliance is strongest when it’s designed into specifications and bid documents up front, rather than addressed after a product has already been ordered or installed.
Approved products can change through substitutions, change orders, supplier shifts, or value engineering, and each of those can affect BABA compliance.
